Climate Change
Our climate change practice has grown out of our expertise in air pollution law and policy. We represented several clients in the Congressional debates on climate legislation. We offer a range of climate-specific services to our clients, including counseling on developing climate change management initiatives and improving air quality management programs to meet current EPA requirements and anticipate future regulations. We routinely advise and represent diverse clients — from developers of electric power plants to clean-tech startups — on business strategies related to climate change legislation and regulation.
We have helped our clients shape market-based programs through legislative or regulatory advocacy on the national and state level. This includes drafting legislation and meeting with key policymakers in Congress and at various federal and state agencies. Our practice spans traditional to emerging control technologies, including carbon capture and sequestration or conversion technologies.
In addition to representing companies before Congress, we work with clients on credit and trading issues. We have significant experience with cap and trade market-based programs, and we provide analysis of how they work and how best to take advantage of them relative to our clients' specific business objectives. Relevant experience includes providing advice under AB 32, California’s climate program, the Regional Greenhouse Gas Initiative (RGGI), and others.
Our approach to climate change matters includes:
- Legislation — Representing clients in the Congressional debates surrounding climate, crafting legislative proposals, and promoting client positions on Capitol Hill and in state and regional global warming initiatives
- Regulation — Representing clients before EPA and state agencies with respect to regulation of greenhouse gas emissions as well as helping clients navigate emissions trading, carbon markets, Clean Air Act new source review, permitting, compliance and enforcement
- Litigation — Counseling clients regarding limiting their liability and participating in current greenhouse gas-related litigation in federal court
- Advising and Counseling – Providing investment bankers and others with the information needed to evaluate the future value of potential energy investments
